Welcome to the e-Moto, LLCTerms & Conditions section. These Terms and Conditions apply to all purchases from our website. Please read them carefully before placing an order.
Pricing Policy
e-Moto maintains a continuous savings pricing policy. We closely monitor other retailers on an ongoing basis to maintain our competitive pricing. e-Moto strives to be open and honest, so we will never raise our prices to set up an artificial 'sale' (a common but illegal retail practice).
We pride ourselves in offering a fast, efficient, friendly and very secure shopping experience, with high quality, innovative products at fair prices.
Tax
e-Moto is based in Kent, Washington, USA, therefore our site shows all prices exclusive of WA state sales tax at the current rate. Customers purchasing our products from states or countries outside of Washington State or where sales tax is not applicable, will not be charged tax at the time of their order unless the order is being delivered to a WA address.
Privacy Policy
We guarantee that every purchase that you make online from our web store, is a secure transaction. Our site uses the highest commercially available level of encryption, 128-bit Secure Socket Layers (SSL). This ensures that your purchases are secure and your information cannot be hijacked or redirected to anyone but e-Moto. Look for the PROTX logo in the bottom-right corner of your browser as you enter the Checkout section of our site and check that the address bar has changed from http… to https (this confirms that you are now in a highly secure trading environment).
The information about you that we hold
If you have bought something from us we will have your email address, address, phone number and credit card details. If you choose to deliver items to a third-party (such as a relative) we will have their name and address. Information is only used to help us deliver the product and keep in contact with you. You may also optionally decide to receive our newsletter and special offers. You can opt-out of this at any time by using the ‘my account’ page to change your personal preferences.
We also maintain an order history of your purchases. This allows you and us to keep track of your deliveries and review your past purchases. We also monitor our website traffic and collect information of a general nature about the number of 'hits' our website gets.
This information lets us know which areas of the site are being visited more than others, helping us to build a more useful site in future re-designs.
Cookies
Our site also uses 'cookies'. Cookies are small packets of data sent to your web browser by a web server. They cause no harm to your machine in any way, as they are small text files with simple information in them. You can view them as small text files inside your 'Temporary Internet Files' folder within Windows. Our cookies keep track of the items in your shopping basket and act as place markers when you move around the site, which can make transitions between pages much faster.
You can of course browse our site without having cookies enabled, but unfortunately our current design relies on cookies to process your shopping cart order and so you will not be able to order online without them... Your information and how we use it
In addition to processing your order, we also maintain an order history of your purchases. This permits you and us to track your deliveries and review your purchase history. We also send out a regular email newsletter. These are only emailed to you if you have opted in to receive newsletters at the point of payment for your order.
If you don't want to receive these offers, or an occasional newsletter, simply send your email name to: unsubscribe@e-Moto.com. You can also change newsletter settings from your 'My Account' page. We will NEVER sell, exchange, or otherwise give away your email address to third parties. Your email address is used solely by yourself, for the sole purpose of logging into your account, and by us for emailing you regarding your orders and to update you with our regular newsletter. Please let us know if you no longer wish to receive our e- catalogues by simply sending your e-mail address to privacy@e-Moto.com
Who else sees your information
We may have to disclose some of your information to service suppliers to help complete your order. These companies include, but not exclusively - UPS, FedEx, USPS, US Customs, etc.
Your Consent

Returns/Guarantees Policy
Guarantee
We guarantee the frame, wheels, footplates, motors, chargers and control gear across our entire range of bikes and scooters for a period of 12 months from the date of purchase. This guarantee does not include general wear and tear, or faults caused by misuse, including but not exclusively - dropping the scooter or bike on to the handlebars, resulting in broken brakes or throttles, broken lights, worn brakes etc. However, If for any reason you are unhappy with your purchase, e.g. the item you have ordered is faulty on arrival, defective or you have had a change of heart, then you must return it to us unused and in its original condition within 14 days for a prompt replacement, exchange or refund.
After the initial 14-day period, we reserve the right to send you either replacement parts for standard items (which we expect you to fit) including brakes, cables, fixings etc. In the unlikely event that the fault is major, we will decide to either refer you to one of our dealers for repair (local to your area) or opt to return the product to us for either replacement or repair.
Batteries are guaranteed for a period of 6 months from the date of purchase.
Returns
How do I return an item? Simply call us on 01242 254540, and a member of our customer support team will issue you with a Returns Authorisation Code that will enable us to process your return quickly and efficiently. You must always obtain a Returns Authorisation Code before sending anything back to us or we will not be able to process your return. We have listed the simple process for each type of return below
Change of heart: Goods returned to us due to a change of heart must be unused and in perfect, re-saleable condition (including product packaging, instructions, etc), otherwise we will not be able to refund you. You are responsible for any other service provided to you in connection with your purchase, e.g. delivery charge. The item(s) must be returned within 14 days of purchase. When first trying out your new bike or scooter, please do so somewhere clean and safe - we can't replace muddy, scratched, dented or soiled e-Moto’s.
Clothing, Helmets and headwear
We are unable to accept returns of helmets, clothing or headwear for hygiene reasons, unless they have a manufacturing fault.
Purchases made by phone or mail:
All purchases made by either phone or mail are treated in the same way as web sales above, with the exception that any returns will incur freight costs to and from the customer, plus a 15% handling and restocking fee.
Items lost in transit
We cannot be held responsible for packages lost in transit: as you are responsible for returning the item(s) to us, we recommend sending the package by Recorded/Special Delivery.
Delivery
e-Moto, LLC complies fully with the distance selling act, where you (the consumer,) have up to 7 days in which to return any goods you receive from us so long as they are unused. The return, charge for return and the care of the goods will then remain the responsibility of you the consumer. If any damage or loss occurs at this stage the consumer will become liable for the cost of the goods.
Refunds, replacement and exchanges
Refunds for products that are defective or faulty or the result of a Change of Heart and sent back to e-Moto, LLC within 14 days, a refund, replacement or exchange will be processed within 7 working days of receipt of the returned item(s) by e-Moto, LLC. A refund will be made using the same method of payment that was used to make the original purchase. Please note that item(s) that are returned to us that are not due to our error, will have the return carriage costs deducted from the refund.
In all instances e-Moto, LLC shall not be liable for incidental or consequential damages or expenses, including but not limited to lost profits or other economic or commercial losses. This warranty does not affect your statutory rights.
Complaints Procedure
e-Moto takes its relationship with customers extremely seriously, and we dedicate a great deal of effort to ensure that we keep you happy. We aim to reply to all emails within one working day of receipt, regardless of the nature of your request. If you prefer to talk to one of our customer support agents, we encourage you to phone us on 1-888-443-6686, where our customer support team will be glad to be of assistance.

No contract will exist between you and e-Moto, LLC for the sale by it to you of any product unless and until e-Moto, LLC accepts your order by e-mail confirming that it has despatched your goods. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time that e-Moto, LLC sends the e-mail to you (whether or not you receive that e-mail). For the avoidance of doubt, any such contract will be deemed to have been concluded in the USA. Further, any such contract will be interpreted, construed and enforced in all respects in accordance with the laws of the United States and you and e-Moto, LLC irrevocably submit to the non-exclusive jurisdiction of the US Courts.
Except as specifically stated on this Web site, to the fullest extent permitted at law, neither e-Moto.com nor any of its affiliates, directors, employees or other representatives will be liable for damages arising out of or in connection with the use of this Web site or the information, content, materials or products included on this site. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.
